Updates On Justice For Duckworth.....

 04/01/2009- Yesterday Kortney Simon was sentenced to LIFE WITHOUT PAROLE. Although we should feel elated. The moment is bittersweet. However this was the best possible outcome for the situation. All we really wanted out of this was to have Tricey's life back- to reverse the outcome of that night. For now this will have to do. We were notified that Kortney Simon is appealing the sentencing. So we will have to continue to fight but we have won round one!!!

03/11/2009-  Jay has won FULL CUSTODY of Alantis Jovan Simon soon to be Alantis Monique Pruitt aka Tweety!!!! The judges order was received this afternoon!!! I know Tricey is smiling down from Heaven!!! Jay kept his promise to his baby sister- Tweety is going to be fine!!! It has been a long hard un-nessesary fight and we are definately glad it is over! Whew! Hopefully the divide between the family can now start closing up...

03/10/2009-  I am really just getting so tired of Kortney and his rights... Sentencing has been continued until March 31st @ 3pm... Here we go again with the b/s... I know the D.A. has to be as fed up as we are... I am ready to confront Kortney as is the rest of Tricey's family and friends... I guess we have to play the waiting game again...

 02/26/2009- I cannot believe it- The defense only called one witness.. Tanjaneika Alexander - the girl house that the police captured Kortney at is still dating him- what a dummy- I guess since he is currently in prison for the attempted murder of that other woman- Kortney hasn't had the opportunity to beat the hell out of her or murder her yet...Kortney's attorney only asked her if she noticed any scratches on him when he came to her house- she said no- The prosecution aked her if it was possible she didn't notice? she said yes... Then the defense rested... That was his defense??? The jury went back at 10:30 am and returned a GUILTY verdict at 4:30 pm !!! Sentencing is set for March 11, 2009 at 2 pm. I know we should be happy about the verdict- but my husband Jay and I came into trial this week knowing that we were not going to be satisfied... Everyone did their job and we are grateful for their hard work- We just wanted Tricey back- for her death sentence to somehow be overturned. For a miricle to happen and when the Guilty verdict was read that Tricey would come walking thru that door to be with her ladies, her brother's, and her family again... I think we all know that didn't happen - so the victory is very bittersweet... As well as a final affirmation that she isn't coming back- no matter what we do....

02/25/2009- We are still moving thru the trial process- The defense attorney is so friggin nerve racking- I wish he would sit down and shut up! If I hear him say something else about Kortney's 5th ammendment, 12 ammendment or any other ammendment rights- I think I will scream!!! What about Tricey's most basic human right? Her right to live? Her right to be safe and secure inside of her home? Her right not to be beaten? Her right to not be  silenced? Her right not be murdered? What about those rights? Today was another long day... One of the guys locked up with Kortney testified today against him. He grew up across the street from him. They were locked up in Jefferson County jail together and Kortney told him what happened. It was said that Kortney had strangled her, she was bleeding from her nose and trying to get her breath back after he let go and she couldn't so Kortney said "Fuck it" and "finished her off"... Isn't that some shit? I don't think Kortney understands that prison really is the safest place for him- because if his feet EVER hit outside of that facility- he will be signing his own death sentence... The nerve of that bastard!

02/24/2009- 15 months to the day - Trial has begun... Kortney decided to take his chances... In the opening statement the prosecution only got to say 2 words before Kortney's attorney declared a mistrial... Prosecutor David Michaels started his opening statement yelling "Momma!!! Momma!!!" because that was our 6 year old neice yelling for her Momma to come back upstairs because our 18 day old neice was crying and she didn't know what to do (and it's 4 am)... However, Momma never came... Momma was downstairs- beaten and strangled to death... Anya took the stand (she will be 8 next week) Jay & I were so proud of her- she did such a good job! The defense attorney tried to trip her up but she got him- and she got him good! He asked her how she knew she yelled for her Momma 20 times... She replied because I counted on my fingers sir... They asked her did she see Kortney in the room and she pointed him out- she showed no fear... Then Momma took the stand and told how Kortney came over and dropped the girls off that morning and told her those lies... Then it was my husband Jay's turn to testify... He had the grueling task of looking at her again as he had found her and he broke down- the asshole defense attorney called for a mistrial again... I mean really how does he expect Jay to look at that and remain composed- Latrisha "Tricey" is not only his baby sister but the person closest to him in this world- his best friend- 1/2 of his soul... What the jury didn't get to hear is that in the absence of their father's growing up- Jay being 10 years older took on a parental role. He has always cared for and protected his sister and his brother. Jay is the first one they call when either one of them need anything- from advice- to money- to just whatever they need at the time... In essence losing Tricey was like losing his child... I have witnessed their bond- and love like that is very rare... Latrisha's last phone call was to Jay at 4 am- not the police, not her "Dad",- but to Jay because she knew he would protect her, he would save her... That 4 am phone call is still haunting him to this day... Our ringer was off and he didn't see the call until the next morning... By then she was gone... Kortney had murdered her.

02/23/2009- Small delay again... Kortney wants to consider pleading guilty overnight... Isn't that crazy??? He gets to think about it! Anyhow- We will know in the morning wiether or not he is pleading guilty or if the prosecution is going to go ahead with jury selection... Either way I just wish they would hurry the _ up! I n a way I hope we go ahead with trial because I want him to have to face us- face what he has done to us... But cowards like him always take the easy way out... 

02/16/2009- Kortney has been transported to the Jefferson County jail and everything is looking good for Monday. Jury selection will start on Monday. It's time to pay the piper Kortney. Tricey's Mom, Jay, Trell and I have already told the D.A. that we did not want to accept any plea deals... Kortney didn't listen to Tricey's pleas for her life- so why should we listen to his? As we go thru this process I will try to keep everyopne updated as much as possible- this will be a very emotional week for all of us... So we will try to keep everyone informed- but please give us a little space. Please keep the Pruitt family in your prayers - we need them... Thanking each and everyone in advance- Christy Pruitt

02/04/2009-  Trial is set for Monday 02/23/2009. Lets hope this does not get continued. I will keep everyone updated as details emerge...

01/18/2009- Delay, delay, delay!  Once again the trial has been continued... I will keep everyone posted- They said that the defense has to be allowed time to have their own lab do their own dna analysis... I think it is really a waste of time- But we don't want a mistrial or appealate issues to come about... I guess justice will have to wait a few more weeks...

 11/22/2008- Trial is  set for Monday Feb 9th, 2009. We'll see... Since I went thru the murder trial with Ms. Causwell for my friend Saudia who was murdered Jan 24, 2007 I know all to well that we very well may be continued again... All of us are just worn out- we want to see justice served and confront Kortney we are ready for this to be done... We feel it is already well over due... I know we must be patient... It's just hard sometimes. We miss you so much...

10/29/2008- Disappointment once again... Jay and I found out today that the trial has been delayed. :( It really saddens my heart that we have to put up this big of a fight for due justice... However , Jay and I are staying on top of it and will not allow for any mishaps nor mistakes... Justice will be served (maybe not the street justice that we would like - but justice never the less) We got you Duck!!! I promise we are going to make him pay... I just wish it would bring you back to us... We miss you more than words could ever express....  I will keep everyone posted on trial date information...

 09/17/2008-  Thank God that Jay and I keep on top of things! Well as you all know at the arraignment for Kortney Simon we were told because he wasn't convicted of the attempted murder until 01/18/2008 that we could not use that felony as a prior to ask for Life without Parole. However Jay and I were not willing to just take that laying down! We made phone calls and did a little investigating on our own! Our personal little vendetta produced 3 prior felonies prior to the attempted murder (3 was the amount needed to pursue Life without Parole). The D.A. will now be seeking Life without Parole!! We have already told him no plea's will be accepted!  See what a little time, effort, concern and elbow grease can do!!! We got him Duck, we got him!

07/29/2008- As expected Kortney Simon pled not guilty to all charges... We were also dealt another blow, the prosecution told us in the beginning that they were asking for life without parole, now they are telling us they are only asking for life. We called the attorney generals office and are having them investigate. I have a feeling we are going to get screwed...  Trial has been set for November 17th, 2008... Now watch that get continued! We see now that the system is not set up for victims at all! It really feels like it is set for the offender and gives the offender more rights than victim! But this is suppose to be justice though...

06/10/2008- Kortney Simon's arraignment has been set for July 29, 2008 @ 9 am. We will be there!

06/09/2008- The new court date has been set for the end of July.... I will update as information comes availible... I am waiting for the Judge to sign off on the date and then I will post it...

Hoover man charged with murder pleads not guilty

A Hoover man charged with murder in the strangulation of the mother of his newborn baby pleaded not guilty today, Birmingham News reporter Robert K. Gordon tells us.
 

Kortney Simon, 28, appeared in court for an arraignment in Bessemer. He is also charged with first-degree theft and first-degree arson.Simon is being held without bail at the Jefferson County Jail, Gordon reports.

Simon is accused in the death of Latrisha Pruitt, 26, of Birmingham. Family members last saw Pruitt at a post-Thanksgiving family dinner last year. As she was leaving, Pruitt told relatives that she would see them the next day to watch the Iron Bowl.

The Birmingham Fire and Rescue Department was called to Pruitt's Dolomite home at 410 West Smithfield Circle at 8:40 p.m. that Saturday night. The fire, which started in the basement, was contained within 20 minutes, but an initial search of the house yielded no body, Gordon reports. Family members went back to search again after not hearing from Pruitt.

Her body was found in her garage behind a Jeep and under a pile of clothes.

Kortney Simon, 28, is also charged with first degree arson and first degree theft. Simon is accused in the death of Latrisha Pruitt, 26, of Birmingham, a single mother of three. Simon is not the father of Pruitt's two other children, ages 6 and 5. He is being held without bail at the Jefferson County Jail. Family members last saw Pruitt Friday night at a post-Thanksgiving family dinner. As she was leaving, Pruitt told her brother's (James & LaTrell Pruitt) that she would see them Saturday to watch the Iron Bowl. Birmingham Fire and Rescue was called to Pruitt's Dolomite home at 410 West Smithfield Circle at 8:40 p.m. on Saturday. The fire - which started in the basement - was contained within 20 minutes, but an initial search of the house yielded no body. All three children were in the house at the time of the argument. Investigators believe Pruitt, a manager at Zaxby's in Bessemer, was strangled to death at that time. Investigators believe that Simon took Pruitt's car and left the children with a relative. Simon was arrested at the house of another woman Monday. Pruitt's brother's got worried when LaTrisha Pruitt, a Jackson-Olin graduate, didn't show for the game. They then learned of the house fire. After arriving, relatives saw that Pruitt's car wasn't there. After not hearing from her, Pruitt's brother's went back to the house to search again. Pruitt's body was found in her garage behind her SUV and under a pile of clothes. Fire authorities returned to the house about 1:30 a.m. Sunday after the body was found ( by her brother's). Her 2008 Dodge Avenger was found Wednesday in Center Point, Washington said. Washington said it appears the fire was set in an effort to conceal the homicide. Court records show Simon has a history of domestic violence. He is scheduled to go on trial in February for the attempted murder of a prostitute in West End, court records show. He pleaded guilty in 2001 to second degree assault and was sentenced to one year probation. He pleaded guilty in 2003 to domestic violence and theft after an attack on his ex-wife, court records show. He served two years and 11 months before being released from prison in April 2006, according to the Alabama Department of Corrections. He was also given two years probation following his April 2006 release. He was arrested on probation revocation in that case in June and was released two months later, court records show. A restraining order was issued in the case upon his release. That case is set for review in February. "This is a tragedy where a single mother of three lost her life for no justifiable reason," Washington said. "This office plans to zealously prosecute this case to the fullest extent of the law."

The undefended victim... For me no gavel hammers, The scales were never weighed...My crime was that of victim, My life the price I paid...When my life was taken, why were my rights not read???And the statement overruled!!! Declared when they pronounced me dead???No lawyer to call on me, to take the witness stand...My Life was taken, My future decided by the offender's hand...Yet, now the courtroom is crowded, and a lawyer pleads his case...And the glimmer of a tear runs down the bastards face....I wish I could take the stand, for the jury to witness my last breath...So they could see the terror in my eyes the moment I faced death...That bastard took me from my children as they slept upstairs...Then set our home on fire, he managed to do all this without shedding tears...Now look at that coward, sitting over there...The D.A.'s not even asking for his life, but yet he's showing fear...But see the D.A. & jury missed my pleading cries, the look upon my face...That's why the scales are "un-balanced" in this unjust case...Can the jury really weigh it all, now listening to his pleas???The bastard only showing emotion now, so one day he may again be free....But what about my family, what about my life???Why was my life worth so little that our legal system gave that bastard rights?I should have let my brother get him, the way he wanted to do...He would have been the D.A.. Jury and the Judge...That bastard wouldn't have faced my brother, he wasn't man enough...Man enough to take what he dished out, and tried to disguise as love...As for that bastard I hope one day he is set free, So my brother's can do to him what he  has done to me...And on that day real justice is served..I will stand at the gates of Hell to get in my last words...I will laugh at him, look him in his face, and ask him how it feels to get what he deserved....

No forgiveness here, I want to see him burn......

06/05/2008- Once again the justice system fails us!!! The Judges office did their job ordering Kortney Simon back from prison, however the prison did not serve Simon his papers!! So we are left with another continuance in this case...  I am so angry right now... Please God, give us the strength to endure this... We will not give up, we will seek justice for Tricey and our family reguardless of what it takes... Please say a prayer for the Pruitt family as they deal with another gut wrenching blow... I ask what will it take to make the justice system not only realize what we have lost, but push them to DO SOMETHING!!!

05/01/2008- The judge signed the order this morning... Kortney will be remanded back to the Jefferson County jail (Bessemer Division) to appear in court on June 5th at 9 am.... We will be there... I will update on how he pleads and the next court date at that time...

04/29/2008- I called the Judge's office and spoke with them ... I will get an order signed in the morning and know a court date- The person I spoke to said no one from the D.A.'s office had requested for this to be done... (Wow, I knew something wasn't sitting well with me...) But thats ok... Jay and I will make sure that this is handled! - We got you Duck...

04/28/2008- Still the same... I bet if this was their loved one, they would be all over it! That did it! I am taking matters into our own hands- I bet we get better results...

04/18/2008- No word yet, and it has been over 2 weeks (just as I thought) I'm going to wait just a little longer before I start calling the judges office myself for answers....

03/25/2008- How about that- The judge in Kortney Simon's case "forgot" to order him back from prison to appear in court today!!! The D.A. assured us that we will get another court date in 2 weeks- at which time we will be the only people inthe court room - opposed to waiting for 100 other defendants to plead their case... I'm not sure I believe him though- I guess time will tell....

03/05/2008- Kortney Simon's court date for the Murder of Latrisha Pruitt has been set for March 25th, 2008 at 9am. The Bessemer D.A.'s office is still only seeking Life Without Parole in Latrisha Pruitt's case....

02/28/2008- Kortney Simon has been moved to Donaldson Correctional Facility (West Jefferson) To begin serving his sentence of Life With Parole(25 years) in his attempted murder conviction, no release date has been set.

02/06/2008- Now on page 2 on this site you can sign an online petition to request that Kortney Simon at least be eligible for the death penalty... We need 15000 signatures in less than 90 days. Please use your name, the D.A.'s office will not accept anonymous signatures. So if you want to make a difference please leave your name

02/04/2008- Relief!! KILBY Correctional facility updated their website and put in the correct information. HE IS currently serving a LIFE SENTENCE WITH THE POSSIBILITY OF PAROLE. No release date is set!

01/30/2008- WE WERE FOOLED!!Today we revealed some shocking news. We decided to go to the KILBY Correctional Facility website and do an inmate search. This yeilded some SHOCKING RESULTS!!! We were told that Kortney Simon had been sentenced to LIFE WITH PAROLE on his attempted murder charge, which means he is SUPPOSE TO SERVE 25 YEARS.... When we did the inmate search we found that HIS RELEASE DATE IS 11/20/2009!!! ISN'T THAT SOME BULL$&*%? My husband is right, good peolple do finish last and MURDERER'S HAVE MORE RIGHT THAN THE VICTIMS... I ask what can we do now???

 01/29/2008- Kortney Simon has been shipped off to KILBY Correctional Facility to begin to serve his LIFE With Parole term for another case as he awaits for the MURDER TRIAL for Tricey's death to begin sometime in the next few months. We are going to begin to petition for signatures to try make him eligiable for the death penalty. He has taken so much from this family... Our grief is exausting... Shouldn't he suffer as well?

 01/28/2008- Tricey's oldest brother James "Jay" has been working on getting a city and county wide resolution in Tricey's name. He accomplished his goal today... Tommorow a gathering of Tricey's closest family members will gather at our home as Ms. Shelia Smoot's office presents us with the county wide resolution. We recieved the City of Birmingham's resolution today. James did this to honor his sister's memory... What a beautiful idea!!!

01/22/2008- We were notified today that Kortney Simon pled guilty to his attempted murder charge ( a crime he committed prior to meeting Tricey ). Simon was dating this woman when he beat her, then ran over her with his car. Perminantly paralizeing this woman.Simon was sentenced to LIFE WITH PAROLE, which in Alabama is 25 years. I ask how many lifes is he allowed to take and how many lifes is he allowed to ruin before the judicial system decides to take his life??? It is our understanding that the D.A.'s office is only seeking LIFE WITHOUT in Tricey's case... Is that really justice I ask? Simon beat his ex-wife (served prison time for domestic violence), He paralized another woman, then he brutally beat and murdered Tricey, leaving her 3 precious children without a mother ( a wonderful, loving mother at that)Not to mention her mother without her only daughter, Her brother's with whom she shared such a unique, tight bond with so much pain, anguish, grief, and anger... I ASK WHERE IS OUR JUSTICE... WHERE IS OUR PEACE??? I implore someone please tell me... shouldn't we be able to settle the score!!!!
